Welcome to Scandiglobe. These Terms of Service ("Terms") govern your access to and use of our website as well as the purchase of products from our store. Scandiglobe is operated by Witteveen E-commerce LLC, a company registered in the United States, and primarily serves customers in Germany and the broader European Union. By accessing our website or placing an order, you agree to these Terms. Please read them carefully before making a purchase.

Where mandatory provisions of German or EU consumer law apply, those provisions take precedence over any conflicting terms below, regardless of the governing law of this agreement.


1. Definitions

  • Return Window: The period within which a customer may request a return, as detailed in our Return & Refund Policy.
  • Customer / Consumer (Verbraucher): Any individual purchasing products from Scandiglobe for personal, non-commercial use within the meaning of § 13 BGB.
  • Business Day: Monday through Friday, excluding public holidays in Germany and the United States.
  • Distance Contract (Fernabsatzvertrag): A contract for the purchase of goods concluded entirely through remote means, without the simultaneous physical presence of both parties, within the meaning of § 312c BGB.
  • Right of Withdrawal (Widerrufsrecht): The customer's statutory right to withdraw from a distance contract within the applicable period as described in our Return & Refund Policy.
  • We / Us / Our: Scandiglobe, operated by Witteveen E-commerce LLC, the business offering products through this website.

3. Scope

These Terms apply to all orders, offers, and contracts between Scandiglobe and customers worldwide. For customers in Germany and the EU, these Terms are subject to and supplemented by applicable mandatory provisions of German consumer law (Verbraucherschutzrecht) and EU consumer protection legislation, including but not limited to Directive 2011/83/EU on consumer rights and Directive 2019/771 on the sale of goods. Any terms or conditions proposed by the customer that differ from these Terms will not be recognized unless expressly agreed to by us in writing.


4. Products & Descriptions

Our product listings are made in good faith and to the best of our knowledge. Scandiglobe offers ceiling lights for residential and commercial use.

Minor variations in color, finish, or appearance may occur due to screen display settings, lighting, or production tolerances. Such variations do not constitute a defect provided they do not affect the normal use and enjoyment of the product.


5. Formation of Contract

Our product listings do not constitute a binding offer but an invitation to place an order (invitatio ad offerendum). A binding contract is formed when you place an order and receive an order confirmation email from us. We reserve the right to refuse or cancel any order, including in cases of obvious pricing errors, product unavailability, or suspected fraudulent activity. In such cases, any payment already made will be refunded promptly.


6. Right of Withdrawal (Widerrufsrecht)

As a consumer in Germany or the EU, you have a statutory right of withdrawal of 14 days from the date of delivery under § 355 BGB and EU Directive 2011/83/EU. We voluntarily extend this period to 30 days as a commercial gesture, in accordance with our Return & Refund Policy.

You may exercise your right of withdrawal without providing a reason. To do so, please notify us clearly at info@scandiglobe.com within the applicable period.

Certain items are excluded from the right of withdrawal under § 312g Abs. 2 BGB — including custom or personalised items. Please refer to our Return & Refund Policy for full details.


7. Customer Obligations During the Withdrawal Period

During the withdrawal period, customers are expected to handle products with reasonable care. Products may only be inspected to the extent necessary to assess their nature, characteristics, and function — as would be permitted in a physical store. In accordance with § 357 Abs. 7 BGB, any diminishment in value resulting from handling beyond what is reasonably necessary may be deducted from the refund amount.


8. Pricing & Payment

Prices on our website are displayed in Euros (EUR, €) and include applicable VAT where required by law. The price applicable is that shown at the time of order confirmation. Orders already confirmed are not affected by subsequent price changes.

9. Shipping & Delivery

We ship worldwide. Orders are processed within 1–2 business days and delivered within an estimated 5–8 business days from the date of dispatch. The order cut-off time is 4:00 PM (CET), Monday through Friday. Shipping is free on all orders.

If delivery is delayed beyond the estimated timeframe, customers in Germany and the EU are entitled to set a reasonable grace period for delivery in accordance with § 323 BGB. If delivery does not occur within that period, the customer may be entitled to withdraw from the contract.

10. Legal Guarantee of Conformity (Gesetzliche Gewährleistung)

We do not offer a separate commercial warranty on our ceiling lights. However, as required by law, all products are covered by the statutory guarantee of conformity under EU Directive 2019/771, as implemented in German law through § 434 et seq. BGB.

Under this guarantee, products must conform to their description, be fit for their intended purpose, and be free from material defects at the time of delivery. The statutory guarantee period is two years from the date of delivery.

If you receive an item that is defective or not as described, please contact us at info@scandiglobe.com. You are entitled to request:

  • Repair or replacement of the defective product (§ 439 BGB)
  • A reduction of the purchase price (§ 441 BGB)
  • Withdrawal from the contract, if repair or replacement fails (§ 440, § 323 BGB)

11. Ongoing Contracts

Where any ongoing service or subscription arrangement is established, either party may terminate it in accordance with applicable law and the terms agreed at the time of sign-up.

All content on this website — including text, images, graphics, logos, and product photography — is the property of Scandiglobe / Witteveen E-commerce LLC or its licensed content providers, and is protected by applicable intellectual property laws. You may not reproduce, distribute, modify, or use any content from this website without our prior written consent.


14. Limitation of Liability

To the fullest extent permitted by applicable law, Scandiglobe / Witteveen E-commerce LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or products. Our total liability for any claim arising out of or relating to a purchase shall not exceed the amount paid for the product in question.

Nothing in these Terms limits or excludes liability that cannot be excluded under applicable law. In particular, we remain fully liable for damages resulting from injury to life, body, or health, for intentional or grossly negligent conduct, and for any liability under the German Product Liability Act (Produkthaftungsgesetz), as required by § 309 Nr. 7 BGB and applicable EU law.


15. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States. Notwithstanding this, customers in Germany and the EU retain the full protection of mandatory German and EU consumer law, which applies regardless of this governing law clause. Any disputes not resolved through our complaints process will be subject to the jurisdiction of the competent courts in accordance with applicable law. For consumers habitually resident in Germany or another EU member state, the courts of their place of residence shall have jurisdiction in accordance with Art. 18 of Regulation (EU) No 1215/2012.


16. Privacy & Data Protection

The protection of your personal data is important to us. We process data in accordance with our Privacy Policy and the General Data Protection Regulation (GDPR), as applicable in Germany and across the European Union. As a US-based company serving German and EU customers, we comply fully with our obligations as a data controller under Art. 4(7) GDPR.


17. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, legal requirements, or services. The current version will always be published on this page with the updated date. Your continued use of our website after any changes constitutes acceptance of the updated Terms.
